6. The International Covenant on
Civil and Political Rights provides, in Article 24 (3), that every child
has the right to acquire a nationality.
7. Article 7 of the Convention on
the Rights of the Child provides that children should be registered immediately
after birth and have the right from birth to, inter alia, acquire a
nationality, and that States parties should ensure the implementation of these
rights in accordance with national law and international obligations, in
particular where the child would otherwise be stateless. According to article
8, States parties should undertake to respect the right of the child to
preserve his or her identity, including their nationality, as recognized by
law, without unlawful interference.
8. Article 9 of the Convention on
the Elimination of All Forms of Discrimination Against Women indicates that
States parties should grant women equal rights with men with respect to the
nationality of their children. According to the Convention, States parties
should also grant women equal rights to acquire, change or retain their nationality,
and ensure in particular that neither marriage to an alien nor change of
nationality by the husband during marriage will automatically change the
nationality of the wife, render her stateless or force upon her the nationality
of the husband. Similar guarantees on the nationality of married women are
contained in the Convention on the Nationality of Married Women.
