New Cambodia Law on Suppression of Human Trafficking and Sexual Exploitation

The new Cambodia Law on the Suppression of Human Trafficking and Sexual Exploitation was approved by the National Assembly of The Royal Government of Cambodia on 20 December 2007, it was approved by the Senate of The Royal Government of Cambodia on 18 January 2008 and it was promulgated by the King on 15 February 2008. The new law provides a much more comprehensive legislative framework to convict human traffickers than previously existing legislation on human trafficking in Cambodia.[1][1] According to the new law, traffickers can be sentenced to up to 20 years in jail and can be fined up to 2,500 U.S. dollars. The new legislation recognises that men, women and children can be victims of trafficking and it could be used to prosecute all forms of trafficking (not only trafficking into sexual exploitation) which is in-line with the Palermo Protocol.

Khmer version of the Law is available from UNIAP:kristy.fleming@undp.org

[2][1] The previous law was the Law on Suppression of the Kidnapping and Trafficking of Human Persons and Exploitation of Human Persons which was passed in 1996. This law was quite short and contained provisions to prosecute trafficking into sexual exploitation. The previous law contained only 10 articles whereas the new law has 52 articles and can be used to prosecute all forms of trafficking.
